1. INTRODUCTION AND ACCEPTANCE These Terms and Conditions govern the sale of goods by MuddyPaws (hereinafter referred to as "we", "us", or "our") to customers (hereinafter referred to as "you" or "your") through our website muddypaws.ie.

By placing an order with us, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

We reserve the right to amend these Terms and Conditions at any time. Any changes will be posted on our website and will apply to orders placed after the date of posting.

3. CONTRACT FORMATION When you place an order, you are making an offer to purchase goods subject to these Terms and Conditions. A binding contract is formed only when we send you an order confirmation email containing your order number, items ordered, prices, and estimated delivery timeframe.

We reserve the right to refuse or cancel any order at any time before dispatch, including cases involving pricing errors, product unavailability, or suspected fraud.

4. PRICING AND AVAILABILITY

4.1 Pricing All prices are displayed in Euro (€) and include VAT where applicable. We make every effort to ensure prices are accurate. In the event of a pricing error, we will contact you to inform you of the correct price. You will have the option to proceed at the correct price or cancel without charge.

4.2 Product Availability All products are subject to availability. If a product becomes unavailable after you place your order, we will contact you to offer a suitable alternative or a full refund.

4.3 Product Descriptions We make every effort to ensure product descriptions and images are accurate. If a product is not as described, your sole remedy is to contact us in accordance with our Returns Policy.

5. PAYMENT We accept debit cards, credit cards, and PayPal. All payments are processed securely. We do not store your card details on our systems.

6. DELIVERY Delivery terms and timeframes are detailed in our Shipping Policy which forms part of these Terms and Conditions. Risk of loss or damage passes to you upon delivery. We will not be liable for delays beyond our reasonable control.

7. RETURNS AND REFUNDS Our returns and refund policy is detailed in our Return & Refund Policy which forms part of these Terms and Conditions. Nothing in these terms affects your statutory rights under Irish and EU consumer protection legislation.

8. YOUR STATUTORY RIGHTS Nothing in these Terms and Conditions affects your statutory rights as a consumer under Irish and European Union law, including but not limited to:

  • The Sale of Goods and Supply of Services Act 1980
  • The Consumer Protection Act 2007
  • Directive 2011/83/EU on Consumer Rights
  • The European Communities (Distance Selling) Regulations 2001

9. LIABILITY Nothing in these Terms excludes our liability for death or personal injury caused by our negligence or fraud. Subject to the above, our total liability shall not exceed the price paid for the relevant products. We shall not be liable for any indirect or consequential losses.

10. DATA PROTECTION AND PRIVACY We are committed to protecting your personal data in accordance with GDPR and the Data Protection Act 2018. We collect only the data necessary to fulfil your order. 12. FORCE MAJEURE We shall not be liable for any failure or delay resulting from circumstances beyond our reasonable control, including acts of God, government actions, war, flood, or failure of telecommunications networks.

13. GOVERNING LAW These Terms and Conditions are governed by the laws of Ireland. The Irish courts shall have jurisdiction over any disputes, subject to your rights to use alternative dispute resolution services. If you are a consumer residing in another EU member state, you may also bring proceedings in the courts of that member state.
